Pistorius Not Appealing Sentence

​​The defence team for Oscar Pistorius has said that it will not be appealing the sentence handed down to him in the High Court on Wednesday.

The Paralympian was sentenced to six years in jail on 6 July 2016, some two years after his first appearance in court for the murder of girlfriend Reeva Steenkamp.


The sentence handed down by Judge Thokozile Masipa is less than half of South Africa's minimum 15-year-jail term sentence for murder, a charge he was found guilty of at the end of 2015.


Following the sentence, Pistorius's attorney said they feel the sentence is fair and that they will not be appealing it. He will serve between half and two thirds of his prison sentence before he applies for parole.


The State is yet to reveal whether it will appeal the sentence but has said that it can't rule out the possibility of doing so.


Judge Masipa has said that she is willing to hear argument for leave to appeal the sentence today.


The Telegraph reports that a source close to the prosecution, prior to the start of sentencing proceedings last month, told them that the State would appeal if the judge handed the athlete less than eight years in prison.


The Telegraph quotes the source as saying: "If all goes according to what we would really like to happen, in the worst-case scenario it would be 10 years. We think she might go down to eight. You would expect the system to work and we will do the best we can. We can only hope for the best but she has disappointed us before.


"If we get a pittance of a sentence, make no mistake we will appeal."


After being handed his sentence, Pistorius was taken directly to prison.


As he was being led down the stairs to the holding cells, his distraught sister Aimee stormed out of court in tears, while relatives consoled his brother Carl.


Initially found guilty of culpable homicide in October 2014, Pistorius was released on parole in October 2015, after serving one year of the five-year term he received for this charge.


The culpable homicide conviction was, however, overturned to one of murder by the Supreme Court of Appeal (SCA) in December 2015. Pistorius filed an application to appeal this decision but it was rejected by the Constitutional Court early in March.


Pistorius was arrested after he killed Steenkamp on 14 February 2013, by shooting her through the bathroom door of his Pretoria home multiple times. He maintains that he mistook her for an intruder and that he was trying to protect them both from harm.
